Welcome to HighTribe. These Terms & Conditions ("Terms") govern your access to and use of the HighTribe website, mobile applications, and related services (collectively, the "Platform"), operated by HighTribe ("HighTribe," "we," "us," or "our").
By accessing or using HighTribe, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About HighTribe
HighTribe is a human-centric travel and community platform that enables users to:
- Discover and share travel footprints, tips, advisories, and stories
- Connect with hosts, guides, creators, and local communities
- Book accommodations, experiences, events, or services offered by third parties
HighTribe acts as a technology platform and facilitator, not as a travel agency, accommodation provider, tour operator, or event organizer.
2. Eligibility
To use HighTribe, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding agreements
- Provide accurate, current, and complete information during registration
We may suspend or terminate accounts that violate these requirements.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities conducted through your account
You agree not to:
- Impersonate others
- Create multiple accounts to bypass restrictions
- Use HighTribe for unlawful, fraudulent, or harmful activities
HighTribe reserves the right to suspend or terminate accounts at its discretion.
4. User Roles
HighTribe users may include, but are not limited to:
- Travelers
- Hosts (accommodation, food, or experience providers)
- Guides
- Event organizers
- Creators and contributors
Each user is solely responsible for the content, services, and experiences they provide.
5. Content & Footprints
Users may post content including text, images, videos, location-based footprints, tips, and advisories ("User Content").
By posting content, you grant HighTribe a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and promote such content in connection with the Platform.
You agree not to post content that:
- Is false, misleading, or fraudulent
- Violates laws or third-party rights
- Is abusive, defamatory, obscene, or harmful
HighTribe may remove content at its discretion.
6. Bookings, Payments & Transactions
HighTribe may facilitate payments between users and third-party hosts or service providers.
- HighTribe is not a party to agreements between users
- Prices, availability, refunds, and cancellations are determined by hosts or providers
- Payments may be processed via third-party payment processors
HighTribe does not guarantee the quality, safety, legality, or delivery of any booking or service.
7. Cancellations & Refunds
Cancellation and refund policies are set by individual hosts or service providers and displayed at the time of booking.
HighTribe is not responsible for disputes arising from cancellations, refunds, or service quality but may assist in facilitating communication.
8. Host & Provider Responsibilities
Hosts, guides, and service providers agree to:
- Provide accurate listings and information
- Comply with applicable laws, licenses, and regulations
- Maintain safety, hygiene, and ethical standards
HighTribe does not inspect, endorse, or guarantee any listings or experiences.
9. Community Conduct
HighTribe is built on trust and respect. Users must not:
- Harass, exploit, or harm others
- Discriminate based on race, religion, gender, nationality, or beliefs
- Use the platform for spam, scams, or manipulation
Violations may result in suspension or permanent removal.
10. Disclaimers
HighTribe is provided on an "as is" and "as available" basis.
We make no warranties regarding:
- Accuracy of user content
- Safety or suitability of experiences
- Continuous or error-free operation
Travel involves inherent risks. Users assume full responsibility for their choices and actions.
11. Limitation of Liability
To the maximum extent permitted by law:
- HighTribe shall not be liable for indirect, incidental, or consequential damages
- HighTribe's total liability shall not exceed the amount paid (if any) to HighTribe in the 12 months preceding the claim
12. Indemnification
You agree to indemnify and hold harmless HighTribe from claims, losses, damages, or expenses arising from:
- Your use of the Platform
- Your content or services
- Your violation of these Terms or applicable laws
13. Intellectual Property
All platform content, branding, trademarks, and technology (excluding User Content) are owned by HighTribe or its licensors.
You may not copy, modify, distribute, or exploit any part of the Platform without written permission.
14. Privacy
Your use of HighTribe is subject to our Privacy Policy, which explains how we collect, use, and protect your data.
15. Termination
You may stop using HighTribe at any time.
HighTribe may suspend or terminate access without notice if:
- These Terms are violated
- Required by law
- The platform or community is at risk
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of HighTribe after updates constitutes acceptance of the revised Terms.
